This Privacy Policy describes Our policies and procedures on the collection, use and disclosure of Your information when You use the Service and tells You about Your privacy rights and how the law protects You.

We use Your Personal data to provide and improve the Service. By using the Service, You agree to the collection and use of information in accordance with this Privacy Policy. This Privacy Policy has been created with the help of the Privacy Policy Generator.

Definitions

For the purposes of this Privacy Policy:

Collecting and Using Your Personal Data

Types of Data Collected

Personal Data

Our Service does not require any personal data to use it. You are welcome to use it completely anonymously.

While using Our Service, you may opt-in to provide Us with certain personally identifiable information that can be used to contact or identify You. Personally identifiable information may include, but is not limited to:

Usage Data

Usage Data is collected automatically when using the Service.

Usage Data may include information such as Your Device's Internet Protocol address (e.g. IP address) and the prompts you used to generate images.

Use of Your Personal Data

On an opt-in basis you may provide us with a contact email to use in case of problems with your Workers but this is not used in any other way.

When registering with an oauth2 provider, we maintain a record of the ID number for your provider without any other identifying information. We only use this to connect your oauth provider to your {{ horde_title }} account.

The described data storage is necessary for the provision and protection of our online services. The legal basis is Recital 49 of the General Data Protection Regulation (GDPR).

Data Subject rights

You have the following rights:

Complaint: Article 77 of the GDPR establishes the right to lodge a complaint with the supervisory authority. The supervisory authority responsible for us is

Retention of Your Personal Data

The Company will retain Your Personal Data only for as long as is necessary for the purposes set out in this Privacy Policy. We will retain and use Your Personal Data to the extent necessary to comply with our legal obligations (for example, if we are required to retain your data to comply with applicable laws), resolve disputes, and enforce our legal agreements and policies.

The Company will also retain Usage Data for internal analysis purposes. Usage Data is generally retained for a shorter period of time, except when this data is used to strengthen the security or to improve the functionality of Our Service, or We are legally obligated to retain this data for longer time periods.

{% if accounting_retention is defined and accounting_retention %}

We record every kudos movement and every generation statistic of Your Account and Your Workers. These records identify Your Account, Your Workers and Your Teams by numeric identifier only, and they are kept when an Account is deleted. {% if accounting_retention.currency_archived %}Kudos movements are kept in Our database for {{ accounting_retention.currency_window_days }} days, then moved to Our archive with Our object storage Service Provider, where they are kept without a fixed end.{% else %}Kudos movements are kept in Our database without a fixed end.{% endif %} Generation statistics are kept for {{ accounting_retention.statistics_window_days }} days, then reduced to daily totals.

{% endif %}

Moderation records

When a Prompt is rejected, or a Worker reports a generation as suspected child sexual abuse material, We record Your Account, any proxied account, Your IP address, a pseudonym of Your IP address, the request and job identifiers, the reporting Worker, the requested models, the Prompt, and any notes moderators add.

When the prompt filter rejects a Prompt, Your Account automatically receives a suspicion mark and Your IP address is placed in a temporary timeout. Repeated rejections of Prompts for NSFW models, or of any Prompt from a flagged Account, from one IP address within an hour also place that IP address in a temporary timeout. A human moderator reviews the records and decides any further action.

{% if moderation_text_in_object_storage %}

The Prompt text of these records is held with Our object storage Service Provider, separately from the record, and is deleted from there on the same schedule as the record's text. Moderators retrieve it through time-limited links.

{% else %}

The Prompt text is held with the record.

{% endif %}

These records are retained as described under Retention of Your Personal Data and are not removed when an Account is deleted. The Prompt text is {% if moderation_text_days is not none %}removed after {{ moderation_text_days }} days{% else %}kept with the record{% endif %}, and the IP address is {% if moderation_ipaddr_days is not none %}removed after {{ moderation_ipaddr_days }} days{% else %}kept with the record{% endif %}, unless the record is subject to moderation action or We are required to retain it, in which case they are kept for as long as that requires. The pseudonym of the IP address is a keyed hash that links records from the same IP address, or the same IPv6 /64 network, without revealing the address; it is kept with the record.

After {{ moderation_ceiling_days }} days, a record that is not subject to moderation action is anonymized: Your Account, the proxied account, the IP address and its pseudonym, the request and job identifiers, and the Prompt are removed. The reason, the outcome, the requested models, the time, the reporting Worker and any moderator notes are kept. The reporting Worker identifies who made the report, not You.

Worker reports of suspected child sexual abuse material are also counted per Account and IP address to alert moderators. Those counts follow the same IP address window and the same {{ moderation_ceiling_days }}-day period, with the same exception for moderation action.

The Service is open source. The handling of these records can be read in Our source code at {{ repository_url }}.

When a Worker raises suspicion, for example through its name or its behavior, We record the Worker's name, the Account that owns it, the kind of suspicion and its details, so moderators can review the Worker's history. {% if worker_suspicion_days is not none %}These records are kept for {{ worker_suspicion_days }} days, including after the Worker or its Account is deleted, unless the Worker's Account is subject to moderation action, in which case they are kept for as long as that requires.{% else %}These records are kept indefinitely, including after the Worker or its Account is deleted.{% endif %}

Transfer of Your Personal Data

{% if accounting_retention is defined and accounting_retention and accounting_retention.currency_archived %}

Your information, including Personal Data, is transferred between the servers of this service and Our object storage Service Providers, which hold generated images{% if moderation_text_in_object_storage %}, the Prompt text of moderation records{% endif %} and the archive of kudos movements, and to no other location or company.

{% else %}

Your information, including Personal Data, is transferred between the servers of this service and Our object storage Service Provider, which holds generated images{% if moderation_text_in_object_storage %} and the Prompt text of moderation records{% endif %}, and to no other location or company.

{% endif %}

Your Prompts are sent to the various workers of this service in order to fulfil the images they requested, without connection to any of your personal information

Tracking Technologies and Cookies

This Service does not use tracking technologies or any cookies whatsoever.

If you decide to create an account using an oauth2 provider, the subsequent cookies needed to automatically authenticate you to your oauth2 provider are subject to your oauth2 provider's privacy policy and this service does not use them in any other way

Business Transactions

If the Company is involved in a merger or acquisition, Your Personal Data may be transferred. We will provide notice before Your Personal Data is transferred and becomes subject to a different Privacy Policy.

Law enforcement

Under certain circumstances, the Company may be required to disclose Your Personal Data if required to do so by law or in response to valid requests by public authorities (e.g. a court or a government agency).

Other legal requirements

The Company may disclose Your Personal Data in the good faith belief that such action is necessary to:

Security of Your Personal Data

The security of Your Personal Data is important to Us, but remember that no method of transmission over the Internet, or method of electronic storage is 100% secure. While We strive to use commercially acceptable means to protect Your Personal Data, We cannot guarantee its absolute security.

Children's Privacy

Our Service does not address anyone under the age of 13. We do not knowingly collect personally identifiable information from anyone under the age of 13. If You are a parent or guardian and You are aware that Your child has provided Us with Personal Data, please contact Us. If We become aware that We have collected Personal Data from anyone under the age of 13 without verification of parental consent, We take steps to remove that information from Our servers.

If We need to rely on consent as a legal basis for processing Your information and Your country requires consent from a parent, We may require Your parent's consent before We collect and use that information.

Our Service may contain links to other websites that are not operated by Us. If You click on a third party link, You will be directed to that third party's site. We strongly advise You to review the Privacy Policy of every site You visit.
